Whistleblowing system webinar: Time is running out to implement a compliant whistleblowing system

On December 16, 2019, the EU Directive 2019/1937 on the protection of whistleblowers came into force. All EU member states now have until December 2021 to convert this directive into their own national laws. The proposed German whistleblower protection law has not yet been made public. Nonetheless, the EU Directive provides minimum standards so it is worthwhile starting to prepare your implementation of the directive today, because all companies have obligations to fulfil in order to comply with it.                         

The EU directive stipulates that all organisations, public and private, with more than 250 employees must set up a reporting system to receive and process notices from whistleblowers by December 17, 2021 at the latest. Smaller companies with 50 to 250 employees have until December 17, 2023. Any organisation that does not meet these deadlines risks severe penalties. The directive also provides requirements on the internal reporting system to be provided and the manner in which reports are to be processed. These requirements relate to the confidentiality of the whistleblower, response times, follow up and feedback, competence of the people managing reports, information, compliance with the GDPR and record-keeping.
